Demerit Points System For Traffic Offences (KEJARA)
- Started implementation on 15 April 2017after receiving Parliamentary approval through the Federal Government Gazette dated 5 April 2017, P.U (A) 110/2017, Schedule 4 of the Road Transport (Demerit Points) Rules 2017.
- In 2020, the list of offences under Subrule 4(1) of the Motor Vehicles (Demerit Points) Rules 2017 was reduced to 20 offences considered under the implementation of the demerit points system. These removed offences involve driving under the influence of alcohol and breath specimen tests showing alcohol levels exceeding the allowed limit, which must be brought to court for consideration and judgment by a Magistrate.
- The implementation of the demerit points system for driving license holdersinvolves several levels of penalties as follows:
- Warning– 20 accumulated points
- First suspension (6 to 8 months)– 20 accumulated points
- Second suspension (8 to 10 months)– 20 or more accumulated points
- Third suspension (10 to 12 months)– 20 or more accumulated points
- Fourth and subsequent suspensions (10 to 12 months)– 20 or more accumulated points
- Demerit point calculation:
- Does not begin when the Offender (OKS) receives a summons notice from JPJ or PDRM;
- Demerit points are calculated when the Offender pays the compound or fine for an offence listed in the Demerit Offences Schedule.
- The offender’s driving license will be REVOKEDif it is suspended 3 times within a 5-year period through the demerit system.
- After the license suspension period ends (12 months),the offender can reapply for a driving license and must start from the beginning of the licensing process as required by JPJ.
