Guide to Voluntary Transfer of Ownership
Guide to Voluntary Exchange of Motor Vehicle Ownership Through Biometric Verification
1.GENERAL CONDITIONS:
- The registered owner (seller) and new owner (buyer) of an individual private vehicle must appear in person for biometric fingerprint verification;
- A representative can only be appointed on behalf of the registered owner or new owner of a vehicle other than the private ownership of an individual;
- Basic documents:
- Individual identity verification: Registered owners and new owners must bring with them identification documents such as myKad, myTentera, myPR and passport.
- Identity verification Government / bank / financial company / insurance / Organization / Cooperative / Private Limited Company / Limited Company / Sole Proprietorship Business / Partnership Business / Statutory Body / Local Authority / Embassy / High Commissioner / Consulate / International Organization:
- A copy of Form 49, a copy of the Resolution / Minutes of the Meeting Regarding Approval of the Sale of Vehicles, Form 9 or Form 13 Certified by the Company Secretary or the Companies Commission of Malaysia (SSM) (Whichever Applicable); Or
- Copy of Form D Certified by SSM; Or
- Any Other Documents Relating to Identity Verification (Relevant);
- Motor Vehicle Sale Approval Letter.
- The official letter appointing a representative must be brought along by the representative; the conditions in 1.a.i are also applicable to the representative.
- Completed JPJK3 form;
- Motor vehicle registration certificate.
- There are no restrictions on THM transactions such as records of ownership claims by financial companies, unsettled customs tax records, blacklist records and so on;
- Motor vehicles except motorcycles must be brought for inspection at PUSPAKOM;
- The commercial vehicle permit for the registered owner has been canceled in advance;
- Fees are paid as prescribed.
2. SPECIAL CONDITIONS / SPECIAL DOCUMENTS
a) Registered owners who are overseas
i. A copy of the passport certified by the Malaysian Embassy where the registered owner is located;
ii. A statement of agreement to sell signed by the registered owner in front of and verified by an official of the Malaysian Embassy where the registered owner is located.
b) Untraceable or unreachable registered owner
i. Court order.
c) Vehicles belonging to companies / partnerships that have been wound up / in the process of liquidation managed by Receivers and Managers / Liquidators
i. Vehicle sale agreement letter;
ii. Copy of form 59 certified by SSM; or
iii. Copy of form 70 certified by SSM; or
iv. Copy of form 72 certified by SSM;
d) Commercial Vehicles
i. Specifically for off-road vehicles must undergo a Special Inspection (B2) at Puspakom first;
ii. Specifically for machinery vehicles / fire vehicles / tow trucks / hearses / must undergo preliminary inspection PG11A / PG13B;
iii. Letter of permit cancellation / letter of approval of modification of conditions by SPAD / LPKP / Ministry of Tourism
iv. Letter of offer of license approval or letter of approval of modification of conditions;
v. The completed JPJK1 form is filled in if the motor vehicle will operate as decontrolled; or
vi. The completed JPJK11 form is filled in if the motor vehicle will operate as off-road;
vii. Certified copy of exemption letter from Treasury / MITI / customs (if applicable).
