Recovery Procedures Of Seized Vehicles
Under Section 64 (1) of the 1987 Road Transportation Act, a Road Transportation Officer can impound a vehicle for the purposes of identifying the operator, the vehicle or halting a continuous offence.
Any vehicles impounded by the JPJ can be reclaimed/released after:-
- The vehicle and the operator’s identity have been ascertained
- The offence committed has been halted
- The vehicle has been cleared by the court
Release of impounded vehicles
Impounded vehicles that have been cleared can be collected by:
- The registered owner
- Financial institutions (if not collected by the owner after a specific time)
- Government agencies such as the police/customs
- Individuals who are appointed by the Estate Administrator
Cleared commercial vehicles can be collected by:
- The company’s director
- The company’s general manager
- Secretary
- An appointed official
Documents required
The vehicle’s registered owner and the claimant must proceed to the JPJ office where the vehicle is impounded along with:
- A written appeal
- The original registration card
- Valid Motor Vehicle Licence and insurance
- A valid driver’s license which has not expired
- Identity card
- The original permit (for commercial/driving school vehicles)
- Form 49
