Guide to Non-Voluntary Change of Ownership

1.GENERAL CONDITIONS:

  1. The new owner (buyer) of an individual’s privately owned vehicle must appear in person to verify fingerprints biometrically;
  2. A representative can be appointed to represent the new owner of a vehicle that is not privately owned by an individual;
  3. Basic documents:
  • Individual Identity Verification: The new owner must bring identification documents such as myKad, myPR, myTentera, and passport.
  • Identity verification Government / bank / financial company / insurance / Organization / Cooperative / Private Limited Company / Limited Company / Sole Proprietorship Business / Partnership Business / Statutory Body / Local Authority / Embassy / High Commissioner / Consulate / International Organization:
  • A copy of form 49, a copy of the vehicle sale agreement resolution, form 9 or form 13 certified by the company secretary or the Companies Commission of Malaysia (SSM) (as applicable); or
  • Copy of form D certified by SSM; or
  • Any other document related to identity verification.
  • The official letter appointing a representative must be brought along by the representative; the conditions in 1.a.i are also applicable to the representative.
  • The completed JPJK3A form is brought along by the new owner or the new owner’s representative
  • Motor vehicle registration certificate.
  1. There are no restrictions on THMSS transactions such as records of ownership claims by financial companies, customs tax records that have not been resolved, blacklist records and so on;
  2. Motor vehicles must be brought for inspection at PUSPAKOM except motorcycles;
  3. The commercial vehicle permit for the registered owner has been canceled in advance;
  4. Fees are paid as prescribed;
  5. Commercial Vehicles
    • Specifically for off-road vehicles, they must undergo a Special Inspection (B2) at Puspakom first;                                        
    • Specifically for machinery vehicles / fire vehicles / tow trucks / hearses / must undergo preliminary inspection PG11A / PG13B;
    • Letter of cancellation of permit / letter of approval of modified conditions by SPAD / LPKP / Ministry of Tourism;
    • Letter of offer of license approval or letter of approval of modification of conditions;
    • The completed JPJK1 form is filled in if the motor vehicle will operate as decontrolled; or
    • The completed JPJK11 form is filled in if the motor vehicle will operate as off-road;
    • Certified copy of exemption letter from Treasury / MITI / customs (if applicable).

2. SPECIAL CONDITIONS / SPECIAL DOCUMENTS

  1. Repossessed motor vehicles are subject to the Hire Purchase Act 1967:
    • Copy of Naming Claim Notice (Table 5);
    • Copy of Notice of Intent to Takeover the Vehicle (Table 4).
  2. Repossessed motor vehicles that are not subject to the Hire Purchase Act 1967
    A copy of the vehicle recall notice according to the agreement.
  3. A motor vehicle belonging to a deceased registered owner
  • A copy of the High Court order certified by the Court; or
  • A copy of the Probate Grant Letter certified by the Court; or
  • Copy of the Letter of Administrator of the Estate certified by the Court; or
  • Copy of Partition Order / Order Granting Power of Attorney under the Small Estates (Division) Act 1955 certified by the Department of the Director General of Lands and Mines; or
  • Copy of the Faraid Order certified by the Syariah Court:
  • Affidavit (made by the heir as in the faraid order) regarding the rejection of the property must be included;
  • the sworn declaration must be made in front of the oath commissioner who serves the government / Magistrate / Judge;
  • This sworn statement must be included when the Faraid Order does not specify the nominee / heir to the deceased’s motor vehicle.
  • A copy of Schedule Three by the Sabah Native Court certified by the Sabah Native Court; or                            
  • A copy of the Order in Form C certified by the Sabah Land and Survey Department Office.
  1. Motor Vehicles forfeited to Government Agencies
  • A copy of the Deprivation Order certified by the Court that issued the order.
  1. Motor Vehicles for the categories of lost and stolen / vehicles that are Beyond Economic Repair (BER) / Total Lost by the insurance party
  • Copy of claim offer letter from insurance;
  • Copy of proof of compensation payment;
  • Copy of proof of receipt of compensation payment;
  • A copy of the Discharge and Indemnity form.
