Recovery Procedures Of Seized Vehicles

Under Section 64(1) of the Road Transport Act 1987, a Road Transport Officer may seize a vehicle for the purpose of identifying the driver’s identity, the vehicle’s identity, or to stop an ongoing offense.

A vehicle seized by the Road Transport Department (JPJ) can be claimed/released once the following matters have been resolved:

  • The identity of the driver or the vehicle has been established.
  • The offense committed has been stopped/resolved.
  • The vehicle is released by court order.

Release of Seized Vehicles

The seized vehicle will be released to the relevant party as follows:

  • The registered owner.
  • Financial institutions (if not claimed by the owner within the stipulated period and must be accompanied by a court order).
  • Government agencies such as the Police or Customs.
  • Individuals authorized under the estate administrator (if the owner has passed away).

For company-owned vehicles, eligible individuals to claim the vehicle include:

  • Director
  • Company Manager
  • Company Secretary
  • Authorized company officer/representative (with written authorization)

Required Documents

The registered owner or the claimant must be present at the relevant JPJ Office (where the vehicle was seized) to claim the vehicle, and bring along the following documents:

  • Valid Vehicle License (LKM) and Insurance (if applicable)
  • Valid and active Driver’s License
  • Identity Card (MyKad) and a copy
  • Original Operator’s License / Permit (for commercial or driving school vehicles)
  • SSM Form 49 (for company vehicles)
