Application Of Seat Belts
Starting from January 1, 2009, the regulation for wearing rear seat belts has been enforced through the Motor Car (Seat Belt) (Amendment 2008) Rules.
This regulation applies to all types of vehicles except for the following:
- Vehicles registered before January 1, 1995.
- Vehicles registered on or after January 1, 1995, but not equipped with built-in rear anchorage points.
- Goods vehicles with a permissible laden weight (BDM) exceeding 3.5 tons.
For vehicles registered on or after January 1, 1995, and equipped with built-in rear anchorage points, but not fitted with rear seat belts, the vehicle owners are given a 3-year period to install the rear seat belts. This period starts from January 1, 2009, to December 31, 2011.
This intervention or initiative through the enforcement of rear seat belt usage aims to reduce injuries and fatalities in the event of road accidents.
Any driver or passenger who does not wear a seat belt (front or rear) will be fined. The penalty for this offense, upon first conviction, is a fine not exceeding RM2,000 or imprisonment not exceeding six (6) months, and for the second or subsequent conviction, a fine not exceeding RM4,000 or imprisonment not exceeding twelve (12) months, or both.
